To prepare a Dubai apartment for sale, confirm the ownership record, clear any service-charge issues, arrange the developer’s e-NOC, and have the sale documents ready before marketing starts. A seller with a mortgage also needs a bank liability letter, while a rented unit requires the tenancy contract to be checked in Contract F. Service-charge eNOCs issued through Mollak usually take 3–5 working days and do not replace the developer’s NOC. The DLD sale-registration fee is 4% of the contract value and is paid by the buyer, as is standard in the Dubai market.
Start with the ownership record and your sale file
The first task is to confirm that the apartment, owner details and project information are correctly recorded before a buyer is found. The seller should check the title deed and the project record in Dubai REST, especially where the title deed was issued some time ago, ownership has changed, or parking spaces and other allocated facilities need to be identified. A practical guide to checking ownership and the project in Dubai REST can help before any payment arrangements are discussed.
For a completed freehold apartment, the core sale file usually includes:
- the original or available electronic title deed;
- the seller’s passport and UAE ID where applicable;
- details of the broker and the active marketing agreement;
- the developer’s e-NOC for the transfer;
- evidence that service charges are settled or that the required clearance process is underway;
- a bank liability letter if the apartment is mortgaged;
- the tenancy contract if the apartment is rented.
Ownership transfer is registered through a Real Estate Registration Trustee office. The buyer and seller, or their properly authorised representatives, attend the transfer process with the required documents. DLD states that an electronic title deed is issued after registration. The full sequence, from appointing a broker to transfer registration, is set out in our guide on how to sell property in Dubai.
If the property is still off-plan rather than completed, the ownership record may be an oqood registration, officially a registration in the Interim Real Property Register under Law No. 13 of 2008. The preparation steps and transfer process can differ from a completed title-deed sale. Do not present an oqood as a completed title deed.
Appoint a broker under Contract A
A broker should market the apartment under an active Contract A. This is the electronic marketing agreement between the seller and the brokerage company. It sets out the broker’s authority to market the property and should be reviewed before advertising begins, including the asking price, agreed commission and the apartment details to be used in the listing.
Dubai’s brokerage framework is linked to Bylaw No. 85 of 2006 Regulating the Real Property Brokers Register. Brokers use electronic contracts: Contract A for the seller-broker marketing relationship, Contract B for the buyer-broker relationship, and Contract F for the unified sale agreement between seller and buyer. Contract F is created from active Contracts A and B and records the payment plan and DLD fees.
The listing itself requires a Trakheesi advertising permit arranged by the broker. A seller should ask to see that the advertised apartment matches the title deed, bedroom count, size information and current condition. If the apartment is tenant occupied, the marketing must also describe its status accurately rather than implying vacant possession where that is not the case.
The broker can explain the sale procedure, prepare the marketing material, coordinate documents and accompany the parties through the transaction. A broker does not receive, exchange or transfer client money, open accounts, or arrange loans. Bank lending and mortgage decisions are made by banks; ask your own bank about its requirements and timings.
Developer NOC and service-charge clearance are separate tasks
For a freehold resale, an e-NOC from the developer is required for the sale-registration process. The application is made through Dubai REST. The document is the developer’s no-objection certificate for the ownership transfer; see what a developer NOC is and how it is obtained in Dubai for the role it plays in a resale.
Do not leave the e-NOC until the scheduled transfer date. The developer may need to review the owner record, the unit’s status and any amounts due before issuing it. The published materials confirm that the developer’s e-NOC is required, but do not publish one standard price for all developers. The applicable charge, supporting documents and processing conditions should therefore be confirmed for the particular building.
Service charges through Mollak
Service charges are annual building charges based on RERA-approved rates and are paid through Mollak to approved accounts. Before putting the apartment on the market, request an account statement or confirm the current balance with the building’s management arrangements. An unpaid balance can block the property record and delay the sale.
Mollak may issue an eNOC for properties where the owner receives Mollak invoices. The stated processing period is 3–5 working days. This service-charge eNOC is useful evidence for the account position, but it does not replace the developer’s e-NOC required for the property transfer.
| Document | What it addresses | What it does not replace |
|---|---|---|
| Developer e-NOC | Developer approval for the freehold resale transfer | Service-charge clearance documentation |
| Mollak eNOC | Service-charge position for eligible Mollak-billed properties | Developer e-NOC for transfer |
Resolve disputed or missing entries early. A buyer, broker and trustee office cannot reliably plan a transfer while the unit may be blocked by outstanding building dues.
If the apartment has a mortgage or a tenant
A mortgaged apartment can be sold, but the mortgage release has to be part of the transaction plan. The seller obtains a liability letter from the lending bank showing the outstanding amount. For a mortgaged sale, DLD’s process refers to three manager cheques: one to the bank or developer for the liability amount, one to the seller for the remaining balance, and one to DLD for the registration fee. After the debt is settled, the bank issues the mortgage release letter.
The mortgage-registration fee is 0.25% of the mortgage amount, and the published fee for mortgage release is AED 1,000. These are registration items, not a substitute for checking the lender’s own documents and release procedure. The bank decides the conditions for releasing its mortgage, so obtain its current instructions before committing to a transfer date.
If the apartment is rented, provide the current tenancy contract and ensure that it can be checked in Contract F. This allows the buyer to see that the sale agreement reflects the apartment’s tenancy position. The sale preparation process should distinguish clearly between a vacant unit and a tenant-occupied unit. The applicable arrangements depend on the individual tenancy and sale documentation.
A seller abroad may act through a representative holding a power of attorney. Legal advisers report that DLD tightened power-of-attorney verification in 2025. Requirements should be checked well in advance because the form, authority wording, authentication and translation requirements can depend on the document and transaction.
Prepare the apartment for photos and viewings
Home staging in Dubai does not require expensive alterations. The purpose is to let buyers see the actual apartment, its condition and its usable space without distractions. Begin with repairs that are small but visible: loose handles, damaged switches, leaking fittings, doors that do not close properly, chipped paint and similar defects. Any work affecting common areas, building systems or the external appearance must follow the building’s rules and approval process.
Deep cleaning should be completed before photography, not after the listing goes live. Clean windows, bathrooms, kitchen surfaces, balconies, air-conditioning grilles where accessible, and storage areas. Remove excess personal belongings, visible cleaning equipment and temporary clutter. An empty or minimally furnished room can be easier to understand in photographs than a room filled with possessions.
Use professional photographs and include an accurate floor plan where available. A floor plan helps a buyer assess room layout, circulation, balconies, storage and parking allocation alongside the listing images. Do not alter images in a way that misrepresents the property’s size, view, finishes or current condition.
Prepare a simple viewing routine. Keep keys available, confirm access arrangements with reception or building security where needed, and give the broker practical instructions for parking, lift access and entry. If a tenant occupies the apartment, viewing times need to work with the tenancy arrangement. Missed access appointments reduce the number of meaningful inspections, even where the listing has generated interest.
Set the asking price from completed DLD transactions
An asking price should begin with completed DLD transactions in the same building, then be adjusted for the unit’s floor, view, size, layout, condition, parking and tenancy status. Current online asking prices show what other sellers hope to achieve; they are not evidence of completed prices.
Ask the broker to explain which recorded transactions are being compared and why a particular apartment is above or below them. A small number of close comparables in the same tower can be more useful than a broad average across a district with different developers, handover periods and service-charge structures.
The sale agreement should also state how the DLD registration fee is allocated. The fee for sale registration is 4% of the contract value, and the buyer pays it; this is the standard in the Dubai market. Formally, Executive Council Resolution No. 30 of 2013 lets the parties agree a different split.
Other published transfer charges include AED 250 for the title deed, AED 250 for an apartment or villa map, AED 225 for a Dubai Municipality unified map, and AED 10 each for knowledge and innovation fees. Trustee service-partner charges are AED 4,000 plus VAT where the price is AED 500,000 or more, and AED 2,000 plus VAT where the price is below AED 500,000. The allocation of costs between the parties should be recorded in Contract F. For a broader estimate of DLD and trustee charges, use the Dubai property fees calculator.
From offer to transfer registration
Once a buyer is ready to proceed, the broker prepares the electronic contract path. Contract F records the agreed sale terms, payment plan and fee allocation. Check the names, title-deed details, price, payment milestones, mortgage status, tenant information and stated expenses before signing.
Bring the original documents and bank papers requested for the trustee appointment. The trustee office processes the ownership transfer once the parties meet the applicable requirements, including the developer e-NOC for a freehold resale. For a mortgaged property, the liability settlement and release process must be coordinated with the bank before the title can be transferred without the existing mortgage.
A seller should not treat the property as ready merely because photographs have been taken or an offer has been made. Readiness means that ownership information, developer documentation, service-charge status, mortgage documentation where relevant, and physical access are aligned with the intended transfer date.
Frequently asked questions
What documents do I need to sell an apartment in Dubai?
Prepare the title deed, passport and UAE ID where applicable, Contract A with the broker, developer e-NOC, service-charge information, and a bank liability letter if there is a mortgage. A rented apartment also requires the tenancy contract for review in Contract F.
Do I need a NOC to sell property in Dubai?
Yes, an e-NOC from the developer is required for a freehold sale-registration process. A Mollak eNOC for service charges is separate and does not replace the developer NOC.
Can unpaid service charges stop a Dubai property sale?
They can block the property record and delay the transaction. Service charges are paid under RERA-approved rates through Mollak, so check the balance before marketing and address any outstanding amount early.
How long does a Mollak eNOC take?
The stated processing period is 3–5 working days for eligible properties where the owner receives Mollak invoices.
What happens if I am selling an apartment with a mortgage?
Obtain a liability letter from the bank. The published mortgaged-sale process uses manager cheques for the outstanding debt, the seller’s remaining balance and the DLD fee, followed by the bank’s mortgage release letter.
Who pays the 4% DLD transfer fee?
The buyer. The 4% DLD sale-registration fee is paid by the buyer, which is the standard in the Dubai market, and the allocation is fixed in the sale agreement.
Can I sell a Dubai apartment while living abroad?
It may be possible through a representative under a power of attorney, subject to current DLD verification requirements. Confirm the requirements before arranging the transaction.
