A “blocked” property is one with a restriction recorded against it in the Dubai Land Department property record. While the restriction remains, a sale cannot be registered, so it must be cleared before registration or through an agreed part of the deal. For a court attachment, the law permits the attachment to be lifted by depositing the debt and expenses with the Court’s Treasury (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 244).

We can look for a buyer quickly and prepare the sale alongside your lawyer, bank or creditor so the restriction can be removed before transfer registration. We cannot promise a price or timing. The likely sale price may be below what you paid, and some blocked properties will not find a buyer until the restriction is lifted.

What kind of block is it?

Court attachment: how it works

  1. Prejudgment attachment. Before a judgment, a creditor may ask the court or the judge of urgent matters to attach property where there is a risk that security will be lost. The stated grounds include no permanent residence in the UAE, or serious grounds to fear that the debtor may abscond, or remove or conceal their assets (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 247).
  2. The creditor must continue the case. If the judge of urgent matters made the attachment order, the creditor must file a case to establish the right within 8 days from the attachment decision. If this is missed, the attachment is void from the outset (Civil Procedure Code, Art. 250(2)).
  3. Attachment to enforce a judgment. The execution judge issues the attachment decision, and it is registered in the real property register. Registration means the property is deemed attached (Civil Procedure Code, Art. 286).
  4. A later sale does not solve the problem. A disposition registered after the attachment does not take effect against the judgment creditors or the person awarded the property at auction (Civil Procedure Code, Art. 292(1)). A private agreement cannot safely bypass the attachment.
  5. Rent is affected too. Income from the property after registration of the attachment is treated as part of the real property and is paid into the Court’s Treasury (Civil Procedure Code, Art. 292).
  6. If the position is not resolved, the property may go to public auction. The purchaser can then be registered on the court’s letter and auction award letter.

How a block is removed so you can sell

Sometimes a debt is paid from sale money. The payment structure must be agreed in advance with your lawyer and the creditor or bank. Do not assume that a buyer’s funds can be used in a particular way without that agreement.

Why selling before an auction is usually better

A public auction is a forced sale process. A sale you arrange before that point gives you more control over the buyer, the proposed price and the transaction steps. This does not mean a sale will be easy: the price will likely be lower than you paid, and timing depends on how quickly the restriction can be cleared. In some cases, waiting until the restriction is lifted is the only realistic route to a buyer.

Frequently asked questions

Can I sell a Dubai property under attachment?

A transfer registered after an attachment does not take effect against judgment creditors or the auction buyer. The attachment normally needs to be lifted, or the transaction structure agreed in advance with your lawyer and the creditor or bank (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 292(1)).

How is a court attachment lifted?

Before an auction is awarded, the debt and expenses may be deposited with the Court’s Treasury. This lifts the attachment from the property and transfers it to the amount deposited (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 244). Payment or settlement may also lead to a request to remove the restriction.

What if the creditor does not file the case in 8 days?

Where an attachment was ordered by the judge of urgent matters, the creditor must file a case to establish the right within 8 days from the attachment decision. If not, the attachment is void from the outset (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 250(2)).

Does a travel ban stop me from selling my property?

A travel ban restricts the person rather than attaching the property. It may be linked to the same debt, so a lawyer should check if there is also a property restriction or attachment.

Can service-charge debt be paid from the sale money?

This can depend on the transaction structure and the parties involved. The arrangement should be agreed in advance with your lawyer and the Management Entity; the unit may not be disposed of until the charges are paid to the Management Entity (Dubai Law No. 6 of 2019, Art. 32(a)).

Do you promise a sale price or sale date?

No. A blocked property may sell below the price you paid, and the timing depends on the buyer and on clearing the restriction. Some properties do not find a buyer until the restriction has been lifted.
