Developer offers in Dubai: types of deals, how buyers get them through an agency and what to check in the SPA

Renat BashirovUpdated: 30 October 202614 min read

Information is current as of October 2026. A developer offer can reduce a defined purchase cost or change the payment schedule, but it is only useful if its amount, conditions and payment responsibility appear in the SPA. For an initial sale, the published DLD registration tariff is 2% from the seller and 2% from the buyer, plus AED 10 knowledge and AED 10 innovation fees; marketing language about a “4% DLD waiver” must be checked against the contract. Whether buying through an agency changes your cost is a contractual matter, not a legal rule; confirm the price and any buyer-side commission in writing before reservation.

Developer offers in Dubai: what they are and why the wording matters

Developer offers in Dubai are commercial campaign terms, not state benefits. They can apply to an entire launch, a limited group of units, a particular payment method, or a reservation made before a stated deadline. The same project may have different conditions for different unit types.

For a private buyer, the central question is not whether an offer sounds large. It is whether it lowers a cost that you would otherwise pay, postpones a payment, or adds an item whose scope is clearly described. A “waiver,” “support,” “package,” or “guaranteed return” has no practical value if the SPA does not say who provides it, under what conditions, and what happens if the buyer misses a payment or resells before handover.

A promotion is not evidence that values will rise or that a price is attractive. Request current transaction evidence for the specific area and property type instead of relying on launch advertising or a general market narrative.

An agency can compare unit availability, payment calendars and SPA wording across projects. It cannot give a tax opinion, legal conclusion, mortgage approval, open accounts, exchange money, accept client money or transfer funds on a buyer’s behalf. Where the transaction raises tax, inheritance, financing or contract-enforcement questions, speak with a qualified tax adviser, lawyer or bank.

Common developer offers and what to check in the SPA

Offer type How it usually appears What to check in the SPA Practical issues
DLD fee waiver or contribution The developer says it will pay all or part of the registration charge described as 4% DLD. State the exact amount or percentage, which party pays each element, the payment date, and whether the benefit is lost after a missed instalment or resale. DLD’s published initial-sale tariff is 2% seller plus 2% buyer, while market advertising often describes the whole 4% as a buyer cost. The contract must resolve this difference.
Post-handover payment plan A portion of the price remains payable after handover rather than entirely during construction. Identify the handover trigger, each post-handover due date, late-payment consequences, interest or penalties if stated, and restrictions on title transfer or resale. A lower pre-handover instalment does not reduce the total price. You need a payment plan that remains affordable after receiving the unit.
Discount for 100% payment The buyer is offered a reduced price for paying the full price early or at reservation. Record the discounted SPA price, payment deadline, refund and cancellation terms, and whether the discount disappears after a delayed transfer. No dated public examples with 2025–2026 terms were identified. Treat verbal claims as unconfirmed until written into the SPA.
Service-charge waiver or support The developer covers service charges for a defined period after handover. Specify the period, covered budget items, monetary cap if any, exclusions, start date, and who pays charges after the offer ends. Service charges continue after the promotional period. Review how service charges affect ownership costs and rental returns before comparing offers.
Furniture package The unit is offered furnished or with a furniture and appliance package. Attach an inventory, specifications, delivery date, warranties, replacement rules and any right to substitute items. No dated public examples were identified with a full inventory and value. “Fully furnished” is too vague without an annex.
Guaranteed income The developer or an affiliated operator promises a stated rental return or income payment. Check whether the promise is in the SPA or a separate agreement, its duration, payment dates, conditions, exclusions, security and termination rights. Published current examples with terms were not identified. A historical legal commentary from 19 November 2017 described limited regulatory framing and terms drafted by the developer; have a lawyer review any such document.

A historical example from 25 September 2020 described a service-charge exemption lasting up to 10 years, subject to that campaign’s payment structure. It is not evidence of a current offer. A broker market review (Betterhomes, 11 August 2026) referred to DLD-fee waivers, limited-period service-charge support, furniture packages and extended post-handover plans on selected launches, without publishing complete terms for every incentive. Conditions change; verify them with the developer before reserving a unit.

What “developer pays 4% DLD” can mean

The DLD page for registration of an initial sale states a registration tariff of 2% from the seller and 2% from the buyer, plus AED 10 knowledge and AED 10 innovation fees. It also states that the developer pays AED 1,000 for self-registration in Oqood. Oqood is the official preliminary registration system for off-plan sales.

Market materials commonly call the registration cost a “4% DLD fee” and advertise that a developer will “absorb” or “waive” it. The published tariff and this market wording do not answer the same question. One describes how the DLD tariff is divided between the parties; the other describes a commercial promise about who bears the cost. Sources differ on the precise practical meaning of a 4% waiver, so confirm the current arrangement with DLD and require the SPA to state it.

The SPA should say whether the developer pays 4%, 2%, or another defined amount; whether payment is made directly at registration or credited to the buyer; whether knowledge and innovation fees are included; and whether a missed instalment cancels the benefit. Market reporting has also indicated that a waiver may not transfer to a buyer on an off-plan resale. That should be stated rather than assumed.

A broker’s calculation published on 11 August 2026 used an off-plan apartment median of AED 1,941,130 and estimated 4% at about AED 77,645; for a villa median of AED 6,791,380, it estimated about AED 271,655. These are illustrations from that market review, not a quote for any particular unit. Use a Dubai property purchase-cost calculator to model the registration charge and trustee-related costs for your intended price, then compare the result with the wording of the offer.

Post-handover payment plans: flexibility with a later obligation

A post-handover payment plan means that part of the purchase price falls due after the property is handed over. It does not mean that the later balance disappears. The buyer still needs to understand the full price, the instalment calendar and the consequences of late payment.

A market report dated 19 January 2026 described a move away from long post-handover schedules toward plans linked more closely to construction progress. It referred to 70/30 and 80/20 structures as market expectations expressed by a broker, not official rules. Do not treat any split as standard for all projects.

Ask for a single schedule showing reservation payment, construction-linked payments, the handover balance and each post-handover instalment. Check whether the handover date is an estimate, whether occupancy or title transfer depends on full payment, and whether resale is prohibited until a specified portion is paid. The SPA commonly gives the developer rights if payments are late, including termination consequences and possible deductions. Law No. 19 of 2017 sets statutory rules on amounts that may be retained in certain buyer-default situations; a lawyer can explain how those provisions apply to your facts.

Payments for off-plan property should go only to the project escrow account. Under Law No. 8 of 2007, Article 7, the escrow account is established in the name of the project under an agreement between the developer and escrow agent. Before paying, verify the project and escrow details through the relevant Dubai REST/Mashrooi records, and follow the process described in how to pay a Dubai developer through escrow. An agency does not receive or hold the buyer’s funds.

Construction-linked payments, escrow arrangements and delay exposure are separate from promotional terms. Read the practical buyer protections and limits in off-plan risks and buyer protection in Dubai.

Buying directly or through an agency: price, commission and access

There is no identified law or DLD rule stating that a buyer must receive the same price directly from the developer and through an agency. There is also no identified rule stating that the developer must pay the agency’s commission on every off-plan sale. Market participants often say that developers pay broker commission and that direct purchase is usually not cheaper, but published market accounts conflict on who normally pays. Developer-paid commission is market practice rather than a legal rule, so ask for it to be confirmed in writing; this is a contractual issue, not a promise to rely on.

Before you sign a reservation form, ask for written confirmation that the SPA price is the developer’s quoted price for that unit and that no agency commission will be charged to you in addition to that price. Ask separately whether any administration fee, reservation fee, registration fee or other charge is payable by you. Executive Council Resolution No. 6 of 2010, Article 12, prohibits a broker from receiving the property price other than through escrow and from deducting commission from that price.

An off-plan broker must have a marketing contract with the developer, registered with DLD. This is one reason to check both the selling party and the agency rather than relying on a social-media listing. Use the guide to checking a Dubai developer and agent before providing documents or funds.

An agency may receive launch conditions, available units or campaign updates through its registered developer relationship. It can also compare offers by their SPA wording, identify missing terms and request written clarification or a revised commercial term. It cannot promise priority allocation: public criteria for agency tiers, preferential units and launch access have not been established, and market accounts conflict.

From reservation to Oqood registration

Start with the unit number, price, payment schedule and a written list of every incentive. Do not reserve based only on a presentation slide or messaging exchange. If an EOI or booking payment is requested, read the form before paying: the refund trigger, deadline and deductions depend on its wording. See how EOI and developer deposit refunds work in Dubai for the questions to raise before reservation.

Then compare the SPA against the reservation terms. The offer should appear in the SPA itself or in a clearly incorporated signed schedule. A separate marketing brochure should not be treated as a replacement for contractual language.

The developer registers the initial sale in the preliminary register through Oqood within 90 days. The buyer receives the preliminary registration certificate by email. Check the purchaser name, unit number, project details and stated price as soon as it arrives.

Executive Council Resolution No. 6 of 2010, Article 8, states that a developer may not charge buyers for legal actions concerning a unit other than DLD-approved charges. If the SPA includes an unfamiliar legal or administrative charge, ask the developer to identify the approved basis. A lawyer should advise if the explanation is unclear or the amount is material.

SPA checklist before signing

  • Confirm the exact unit number, area, price, payment currency stated in the contract and all instalment dates.
  • Match every offer to a SPA clause: DLD contribution, service-charge support, furniture, post-handover schedule or income promise.
  • Record the benefit’s amount, expiry date, conditions, cancellation triggers and whether it transfers on resale.
  • Check the estimated handover date, permitted extension rights, snagging process and defect-remedy procedure.
  • Read default, termination, refund and deduction clauses alongside the statutory framework in Law No. 19 of 2017.
  • Check whether resale is restricted before a defined percentage of the price has been paid.
  • Confirm the project escrow account before each payment and keep payment confirmations.
  • Ask who pays every registration-related amount and whether any agency commission is added to the SPA price.

SPA clauses on handover delays, force majeure, buyer default and dispute resolution can have consequences beyond the commercial offer. A broker can explain where the clauses sit and compare them with the reservation terms. Contract interpretation and legal remedies require independent legal advice.

Frequently asked questions

Is it cheaper to buy directly from a developer in Dubai?

There is no identified legal rule requiring a lower direct price. Market views differ, so obtain the unit price and confirmation of buyer-side commission in writing before reservation.

Does a developer paying 4% DLD mean I pay no registration cost?

Not necessarily. DLD publishes a 2% seller and 2% buyer tariff for an initial sale, plus AED 10 knowledge and AED 10 innovation fees. The SPA must state which amounts the developer covers.

What is Oqood?

Oqood is the official preliminary registration system for off-plan sales. The initial sale should be registered within 90 days, and the certificate is sent to the buyer by email.

Can I pay the agency for an off-plan unit?

Property payments should go to the project escrow account, not to the agency. The broker does not accept or transfer client funds.

What should I check in a post-handover payment plan?

Check the full payment calendar, handover trigger, late-payment consequences, title-transfer conditions and resale restrictions. A deferred instalment remains your obligation after handover.

Are furniture packages and guaranteed income offers reliable?

They require detailed written terms. No dated public 2025–2026 examples were identified with complete furniture specifications or current guaranteed-income conditions.

Can an agency secure better launch units or terms?

An agency may have access to developer campaign information and can negotiate or request clarification, but there are no verified public criteria guaranteeing allocation priority or better terms.
