You may be seeing this message because the developer believes that you have not fulfilled your payment obligations under the off-plan Sales and Purchase Agreement.
In Dubai, if a buyer fails to pay instalments under an off-plan contract, the developer may notify Dubai Land Department and start a formal termination or deregistration procedure. DLD has an official service called Request for Termination of Initial Registration, which allows a developer to apply for deregistration of provisional registration when an investor has breached contractual obligations due to non-payment of instalments under the off-plan sales contract.
In practical language, many owners describe this as the developer “blocking” the apartment.
This can mean that normal actions with the unit may become difficult or impossible until the issue is resolved. For example, the owner may face problems with resale, transfer, NOC, assignment, or further registration.
What Does It Mean for the Owner?
If the procedure is connected to unpaid instalments, the risk is serious.
Under Dubai’s off-plan property rules, after the developer notifies DLD and DLD verifies the buyer’s breach, DLD may serve a written 30-day notice requiring the buyer to fulfil their contractual obligations. A distress sale means the owner is forced to sell the property below market value to avoid a worse financial loss. In this case, the buyer may agree to pay the outstanding amount to the developer and complete the transaction under urgent conditions.
This is not a situation where the owner should wait for the “best” offer. The goal is to reduce the loss and avoid losing the unit entirely.
