A “blocked” property is one with a restriction recorded against it in the Dubai Land Department property record. While the restriction remains, a sale cannot be registered, so it must be cleared before registration or through an agreed part of the deal. For a court attachment, the law permits the attachment to be lifted by depositing the debt and expenses with the Court’s Treasury (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 244).

We can look for a buyer quickly and prepare the sale alongside your lawyer, bank or creditor so the restriction can be removed before transfer registration. We cannot promise a price or timing. The likely sale price may be below what you paid, and some blocked properties will not find a buyer until the restriction is lifted.

## What kind of block is it?

- **Bank mortgage.** You may sell a mortgaged unit only with the mortgagee’s approval (Dubai Law No. 14 of 2008, Art. 10). For a registered sale of a mortgaged property, the bank’s liability letter is required. Read [what to do if you cannot pay your mortgage](https://continentalclub.ae/en/cant-pay-mortgage-dubai/).
- **Off-plan developer restriction.** An off-plan transfer or restriction of rights is invalid unless it is recorded in the Interim Property Register (Oqood) (Dubai Law No. 13 of 2008, Art. 3(1)). If payments to the developer are overdue, the position needs careful review before marketing. See [selling an off-plan unit before termination](https://continentalclub.ae/en/cant-pay-developer-off-plan-dubai/).
- **Unpaid service charges.** The Management Entity has a lien for unpaid service charges, and the unit may not be disposed of until those charges are paid to the Management Entity (Dubai Law No. 6 of 2019, Art. 32(a)).
- **Court attachment for a debt.** An attachment can be a precautionary measure before judgment or an enforcement measure after judgment. An enforcement attachment is marked in the property register (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 286).
- **Travel ban.** A travel ban restricts the person, not the property. It can exist alongside a property attachment, but it is not itself an attachment of your unit (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Arts. 324–325).
- **Criminal or anti-money-laundering freeze.** This is a separate category of restriction. It needs advice from a UAE-licensed criminal lawyer. We do not take on these sales until the restriction has been lifted.

## Court attachment: how it works

1. **Prejudgment attachment.** Before a judgment, a creditor may ask the court or the judge of urgent matters to attach property where there is a risk that security will be lost. The stated grounds include no permanent residence in the UAE, or serious grounds to fear that the debtor may abscond, or remove or conceal their assets (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 247).
2. **The creditor must continue the case.** If the judge of urgent matters made the attachment order, the creditor must file a case to establish the right within 8 days from the attachment decision. If this is missed, the attachment is void from the outset (Civil Procedure Code, Art. 250(2)).
3. **Attachment to enforce a judgment.** The execution judge issues the attachment decision, and it is registered in the real property register. Registration means the property is deemed attached (Civil Procedure Code, Art. 286).
4. **A later sale does not solve the problem.** A disposition registered after the attachment does not take effect against the judgment creditors or the person awarded the property at auction (Civil Procedure Code, Art. 292(1)). A private agreement cannot safely bypass the attachment.
5. **Rent is affected too.** Income from the property after registration of the attachment is treated as part of the real property and is paid into the Court’s Treasury (Civil Procedure Code, Art. 292).
6. **If the position is not resolved, the property may go to public auction.** The purchaser can then be registered on the court’s letter and auction award letter.

## How a block is removed so you can sell

- **Deposit with the Court’s Treasury.** Before an auction is awarded, a sum equal to the debts and expenses for which the attachment was made may be deposited with the Court’s Treasury. The effect is that the attachment is lifted from the property and transferred to the deposited amount (Civil Procedure Code, Art. 244). You may also ask the execution judge to determine the amount, or what replaces it, for deposit; deposit lifts the attachment from the property and transfers it to the amount deposited (Civil Procedure Code, Art. 245).
- **Payment or settlement with the creditor.** If the debt is paid or a settlement is reached, the creditor may request removal of the restriction. Your lawyer should confirm the documents and sequence needed for your case.
- **Travel-ban grounds.** A travel ban remains until the obligation ends. The judge may lift it, including where the creditor gives written consent, the debtor provides sufficient bank security or a solvent guarantor, or the debtor deposits the debt and expenses with the Court’s Treasury (Civil Procedure Code, Art. 325).
- **Service charges.** The unpaid charges must be paid to the Management Entity before the unit can be disposed of (Dubai Law No. 6 of 2019, Art. 32(a)).
- **Mortgage.** The bank’s liability letter is part of the sale process for a mortgaged property. It sets out the bank’s position for the transaction.

Sometimes a debt is paid from sale money. The payment structure must be agreed in advance with your lawyer and the creditor or bank. Do not assume that a buyer’s funds can be used in a particular way without that agreement.

## Why selling before an auction is usually better

A public auction is a forced sale process. A sale you arrange before that point gives you more control over the buyer, the proposed price and the transaction steps. This does not mean a sale will be easy: the price will likely be lower than you paid, and timing depends on how quickly the restriction can be cleared. In some cases, waiting until the restriction is lifted is the only realistic route to a buyer.

## What we do and what we do not do

- We look for a buyer and prepare the sale around the steps needed before transfer registration.
- We work alongside your UAE-licensed lawyer, bank or creditor.
- We do not negotiate with creditors, courts or banks on your behalf.
- We do not buy properties ourselves.
- We do not provide legal advice. For legal questions, speak with a UAE-licensed lawyer.
- We do not handle a property subject to a criminal or anti-money-laundering freeze until that restriction has been lifted.

## What to prepare for a free review

Keep these at hand; leave your contact below and we will call back.

- Your title deed or Oqood.
- Any court notice, attachment order or other order you received.
- The bank’s statement or liability letter, if the property is mortgaged.
- Your service-charge statement.
- The amount of the debt, if known.

We can then assess how the property is positioned for marketing and which parties need to be involved before a transfer can be registered.

## Frequently asked questions

### Can I sell a Dubai property under attachment?

A transfer registered after an attachment does not take effect against judgment creditors or the auction buyer. The attachment normally needs to be lifted, or the transaction structure agreed in advance with your lawyer and the creditor or bank (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 292(1)).

### How is a court attachment lifted?

Before an auction is awarded, the debt and expenses may be deposited with the Court’s Treasury. This lifts the attachment from the property and transfers it to the amount deposited (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 244). Payment or settlement may also lead to a request to remove the restriction.

### What if the creditor does not file the case in 8 days?

Where an attachment was ordered by the judge of urgent matters, the creditor must file a case to establish the right within 8 days from the attachment decision. If not, the attachment is void from the outset (Federal Decree-Law No. 42 of 2022, Civil Procedure Code, Art. 250(2)).

### Does a travel ban stop me from selling my property?

A travel ban restricts the person rather than attaching the property. It may be linked to the same debt, so a lawyer should check if there is also a property restriction or attachment.

### Can service-charge debt be paid from the sale money?

This can depend on the transaction structure and the parties involved. The arrangement should be agreed in advance with your lawyer and the Management Entity; the unit may not be disposed of until the charges are paid to the Management Entity (Dubai Law No. 6 of 2019, Art. 32(a)).

### Do you promise a sale price or sale date?

No. A blocked property may sell below the price you paid, and the timing depends on the buyer and on clearing the restriction. Some properties do not find a buyer until the restriction has been lifted.
