If you stop paying a Dubai mortgage, the bank can begin enforcement by serving a notary notice. If the debt remains unpaid after that notice period, an execution judge may order the mortgaged property attached for public auction. If auction proceeds do not cover the debt, the remaining debt does not disappear. Selling on the open market before an auction usually gives you more control and may leave you in a better position.

Continental Club can quickly look for a buyer for your property. We cannot promise a sale price or timing. In many urgent sales, the price is likely to be below what you paid for the property.

## What happens when mortgage payments stop

1. **You remain the owner while the mortgage is in place.** A mortgage does not by itself take away your right to manage the property or receive its income, including rent, before enforcement and auction sale (Dubai Law No. 14 of 2008, Art. 12).
2. **The bank may start enforcement after default.** This can also happen if a condition for early repayment has occurred. Before enforcement, the bank must send you a notice through a notary public giving at least 30 days (Dubai Law No. 14 of 2008, Art. 25).
3. **After the notice period, the property may be attached for auction.** If the debt is not paid after the 30 days, the execution judge may, on the bank’s request, issue an order to attach the mortgaged property for public auction under Dubai Land Department procedures (Dubai Law No. 14 of 2008, Art. 26).
4. **A limited postponement may be possible.** At your request, the execution judge may postpone an auction once, for no more than 60 days, if you can pay within that period or would suffer disproportionate harm from the sale (Dubai Law No. 14 of 2008, Art. 27).
5. **The auction sale does not necessarily end the debt.** If the auction proceeds are not enough, the bank may claim the remaining amount from you. Your personal liability is not limited to the value of the property (Dubai Law No. 14 of 2008, Art. 30).

## What you can still do

- **Ask your bank about a payment arrangement or restructuring.** Banks often consider requests from customers in genuine financial difficulty. The outcome is for the bank to decide, so ask early and keep copies of your communications.
- **Rent out the property.** You may manage the property and receive rental income before enforcement and auction sale (Dubai Law No. 14 of 2008, Art. 12). Check your mortgage agreement before doing this, as its terms may matter.
- **Sell before the auction.** You choose whether to accept a buyer and take part in the price discussion. A sale still needs to cover the bank process, outstanding loan amount, and transaction costs under the agreed sale terms.

## How a sale with an outstanding mortgage works

The first practical step is to obtain a liability letter from your bank. This states the outstanding mortgage amount needed for the transaction.

You and the buyer then attend an accredited Trustee Centre. The registrar checks the documents, enters the transaction in the system, and the Dubai Land Department audits it. Dubai Land Department lists manager’s cheques for the seller’s bank, the seller’s balance from the sale price, and Dubai Land Department among the required items. The sale agreement determines how the transfer and Trustee Centre fees are allocated between buyer and seller.

The buyer’s funds are used to repay the amount due to your bank. After the mortgage release letter is submitted, the registration is completed and title transfers to the buyer. Dubai Land Department states that the Trustee Centre procedure itself takes 15–20 minutes; this is not the time needed to find a buyer or arrange any buyer finance (Dubai Land Department, Registering the Sale of a Mortgaged Property).

## Selling before the auction or waiting for the auction

- **Before the auction:** You initiate the sale through the Dubai Land Department process. You can choose a buyer and participate in agreeing the price.
- **At auction:** The bank starts enforcement through the execution process after the statutory notice and court order steps. You do not choose the buyer or set the price (Dubai Law No. 14 of 2008, Arts. 25–27).
- **Buyer timing at auction:** The successful bidder must pay the remaining amount and expenses within 10 days after the bid is approved. If this does not happen, the deposited amount is forfeited. This can limit the pool of possible bidders (Emirates Auction FAQ).
- **Remaining debt:** In either route, focus on the amount still owed. If auction proceeds fall short, the bank may claim the shortfall from you under Article 30. An open-market sale lets you see and discuss the proposed price before you decide to proceed.

## Frequently asked questions

### Can the bank take my flat without court involvement?

The bank must first send a notary notice giving at least 30 days. If the debt remains unpaid, an execution judge may order the property attached for public auction (Dubai Law No. 14 of 2008, Arts. 25–26).

### How long do I have after the notice?

The notary notice must give at least 30 days before enforcement can proceed (Dubai Law No. 14 of 2008, Art. 25). At your request, a judge may postpone an auction once for no more than 60 days in the circumstances set out in Article 27.

### If I sell below the loan amount, what happens?

The sale needs a clear plan for the amount owed to the bank. If an auction does not cover the debt, the bank may claim the remaining balance from you (Dubai Law No. 14 of 2008, Art. 30). Ask a UAE-licensed lawyer about your individual position.

### Can I rent the property out while this is happening?

Before enforcement and auction sale, you retain the right to manage the mortgaged property and receive income from it, including rent (Dubai Law No. 14 of 2008, Art. 12). Check the terms of your mortgage agreement.

### Do you promise a sale price?

No. We look for a buyer quickly, but we cannot promise a price or completion date. In an urgent sale, the price is likely to be below what you paid.

### How is a mortgaged property transferred to a buyer?

You obtain a bank liability letter, attend an accredited Trustee Centre with the buyer, and the buyer's funds repay the mortgage amount. Once the mortgage release letter is submitted, registration can be completed and title transfers (Dubai Land Department, Registering the Sale of a Mortgaged Property).
