As of October 2026, choose ready property if you need a home or rental income now, want to inspect the building before paying, or plan to use higher-leverage financing. Choose off-plan only if you can follow the payment schedule in the SPA, accept that there is no rent before handover, and are comfortable with construction and resale restrictions. In the latest 12-month DLD data window, off-plan accounted for 68.1% of registrations, while total transactions fell 12.7% and the median transaction price fell 7.1%. Off-plan was not cheaper per square foot at market level: its median was AED 1,788 per sq ft versus AED 1,421 for ready property.

## Dubai market context: do not buy on the assumption that prices must rise

The current choice between off-plan and ready property is not simply a choice between “new” and “old.” It is a choice between two different payment structures, two different timelines and two different sets of risks.

For the 12 months from October 2025 through September 2026, 181,510 sales were registered. That was 12.7% fewer than in the preceding 12-month period. The median transaction price was AED 1,442,944, down 7.1%. These figures describe registered sales, not asking prices in advertisements.

The median market price was AED 1,722 per sq ft, but this number mixes apartments, villas, hotel apartments and different sizes. A studio and a three-bedroom apartment should not be compared by total ticket price alone. The same problem applies to off-plan versus ready: off-plan transactions contain more smaller units, so their median deal price was lower, while their median price per sq ft was higher.

Across all residential registrations in the same 12 months (our calculation from DLD open data), the median off-plan price was AED 1,788 per sq ft, compared with AED 1,421 per sq ft for ready property. That is a 25.8% difference. It does not mean every ready home is cheaper than every off-plan home. It means that the statement “off-plan is always cheaper per foot” is not supported by the market-wide data.

For a meaningful comparison, look at the same area, property type, bedroom count, floor, view, delivery status and service-charge burden. The pages for [Dubai areas with DLD prices and transactions](/location/) can help narrow the comparison before viewing individual units.

## Off-plan versus ready property: the direct comparison

| Criterion | Off-plan property | Ready property |
| --- | --- | --- |
| What you buy | A unit under construction, registered in the Interim Real Property Register. | An existing unit that can usually be inspected before purchase. |
| Payment timing | Instalments under the SPA, linked to the agreed schedule and construction milestones. | Purchase funds, registration fees and transaction costs are generally settled on the transfer date. |
| Registration | Oqood, the official initial-sale registration. | Title transfer and title deed registration. |
| DLD registration fee | The legislation allocates 2% to buyer and 2% to seller unless otherwise agreed; contracts often place the full 4% on the buyer. | The 4% DLD registration fee is normally settled during the transfer process. |
| Mortgage | Bank products may finance up to 50% of value, subject to bank conditions and project status. | For an expatriate buyer, bank products may finance up to 80% in qualifying cases. |
| Rental income | No rent before handover and possession. | Potential rental income can begin after completion of the purchase and leasing process. |
| Inspection | You inspect plans, specifications and later the completed unit. | You can inspect the apartment, common areas and condition of the building before buying. |
| Resale before handover | Depends on the SPA, developer requirements, payment threshold and registration procedure. | Possible after ownership transfer, subject to the normal sale process. |
| Service charges | The start date for a buyer in a new project depends on the case and should be checked in the SPA and handover documents. | Approved annual charges can be checked for the existing building. |
| Main concern | Construction delay, specification changes, payment default consequences and limited liquidity before handover. | Age, wear, maintenance history, immediate full payment requirement and known recurring costs. |

## How off-plan purchase works: SPA, escrow and Oqood

Off-plan purchase is governed by the sale and purchase agreement, usually called the SPA. It should state the unit, net area, payment schedule, completion terms, handover requirements, default provisions and the procedure for assignment or resale. Payment plans such as 60/40, 80/20 or monthly instalments may appear in the market, but they are not fixed by law. The actual schedule is the one written in your SPA.

Dubai Law No. 8 of 2007 requires payments for off-plan units to be deposited into the escrow account of the relevant project. The account is dedicated to that development project. A broker may not accept the unit sale price into its own account or deduct commission before the price is deposited into the project escrow account. For the practical payment sequence, see [how to pay a developer through escrow in Dubai](/how-to-pay-developer-dubai-escrow/).

Escrow is a buyer-protection mechanism, not a guarantee that a property will be completed on a particular date. Under Law No. 8 of 2007, 5% of the total escrow account value is retained after the completion certificate and released to the developer one year after units are registered in purchasers’ names. The escrow agent and DLD also have roles if a project cannot be completed. A fuller explanation of construction-stage protection, delays and documents is available in [off-plan risks and buyer protection in Dubai](/articles/off-plan-risks-dubai-buyer-protection/).

An off-plan unit must be registered in the Interim Real Property Register. Buyers commonly call this registration “oqood”; Oqood is the official initial-sale registration process. The registration is to be completed within 90 days from signing. The buyer fee stated for the Oqood service is 2% plus AED 10 plus AED 10, while the developer has its own registration obligation and fee. Read the process before signing through [Oqood registration for off-plan property](/oqood-off-plan-registration-dubai/).

The legislation provides that the prescribed registration fee is shared 2% by buyer and 2% by seller unless the parties agree otherwise. In many transactions, the SPA assigns the full 4% cost to the buyer. Read the signed SPA rather than relying on a verbal quotation.

A project cannot lawfully be sold off-plan before approval of commencement and registration with DLD. Article 11 of Executive Council Resolution No. 6 of 2010 treats such a disposition as null and void.

## What can go wrong with off-plan, and what the rules actually provide

The difficult part of off-plan is the period between the first payment and handover. There is no rental income while the unit is not available for occupation. A multi-year delivery period does not produce rent during construction, and the buyer remains exposed to the market value when handover or resale becomes possible. No broker can promise what prices will be at that date.

Construction completion dates and grace periods must be checked in the SPA. Market guides quote different grace periods, and no single period is set in the main off-plan regulations; it is a term of the SPA. Do not assume that a marketing timeline is the same as a contractual delivery obligation.

If a developer materially departs from agreed specifications, fails to provide the final sale agreement, does not link payments to construction milestones proposed by RERA, or hands over a unit unfit for use because of material construction defects, Article 20 of Executive Council Resolution No. 6 of 2010 describes circumstances in which a purchaser may resort to the competent court for termination. This is a legal process; individual advice requires a qualified lawyer.

If a cancelled project is subject to a RERA cancellation decision, Articles 25 and 26 of the Resolution provide for a technical report, audit and refund process. Amounts in escrow are to be refunded to entitled parties within 14 days of cancellation, while any shortfall is due from the developer within 60 days unless an extension is granted. The procedure does not remove the need to preserve payment records, SPA copies and correspondence.

The buyer’s own payment default can be expensive. Under the retention framework in Article 15 of Executive Council Resolution No. 6 of 2010 (issued under Law No. 13 of 2008), the developer must give notice and DLD grants a 30-day period to perform. Depending on verified construction progress, termination may allow retention of up to 25% or 40% of the contract price, or up to 30% of amounts paid where construction has not started for reasons beyond the developer’s control. Never sign a payment plan that depends on uncertain future funds.

If the completed unit is more than 5% smaller than the contracted net area, Article 13 of the Resolution requires compensation calculated on the agreed unit price. The developer cannot charge for excess area unless the parties have agreed otherwise.

## Can you sell an off-plan unit before completion?

Yes, an off-plan resale may be possible before handover, but it is not automatic and it is not the same as selling a completed title-deed property. You are transferring rights under an initial sale registration rather than transferring an existing title deed.

Buyers often hear that 30% or 40% must be paid before resale. That percentage is not a universal DLD rule. Market practice varies, and the actual threshold may depend on the SPA and developer policy. The process can also require a no-objection certificate or approval. Market guides differ, so confirm the requirement with DLD and in the signed contract.

The developer may not charge a resale fee beyond administrative costs approved by DLD. Still, you may face registration costs, applicable NOC or administrative charges, and a buyer must be found on terms acceptable to both parties. The legal and procedural distinction is explained in [buying an off-plan resale through Oqood without a title deed](/articles/buying-off-plan-resale-oqood-no-title-deed/).

Do not treat off-plan resale as a guaranteed exit. In a market with fewer transactions, the buyer may need to wait, adjust the asking price or keep making instalments under the SPA.

## Ready property: what you can verify before paying

A ready property transaction is more immediate. The buyer can inspect the actual apartment, layout, view, building entrance, lifts, parking, common areas and surrounding streets. You can also ask for available building documents, check whether the unit is vacant or leased, and understand what is being transferred on the deal date.

The standard transfer process normally involves the buyer, seller, trustee office and, where relevant, a bank. The 4% DLD registration fee is payable as part of the transaction. Mortgage registration is charged at 0.25% of the loan amount. A normal property transfer through a trustee office has a service charge, while the exact transaction costs should be confirmed before signing a reservation or sale agreement.

For the transaction sequence, documents and checks, use [how to buy a ready property in Dubai](/articles/how-to-buy-a-ready-property-in-dubai/). Once the buyer is ready to compare actual completed units, the [catalogue of ready apartments in Dubai](/en/ready/) is more useful than comparing brochure images.

Ready property is not automatically safer in every respect. A building may have wear, pending maintenance, an older layout or higher service charges. However, these issues can often be investigated before transfer rather than discovered at handover.

Service charges are one of the main practical differences. Each owner pays a share based on the unit area, and management cannot demand charges before RERA approval. For an existing building, the approved amount can be checked through the DLD Service Charge Index. See [how service charges affect ownership costs and returns](/articles/what-are-service-charges-in-dubai-and-how-they-impact-your-property-returns/). For a newly delivered off-plan unit, market guides differ on whether charges begin from keys, registration or another contractual event, so confirm this in the SPA and handover paperwork.

## Mortgage, booking money and handover checks

Financing can change the answer even where two units appear similarly priced. Bank pages indicate that off-plan financing may be available up to 50% of property value, subject to lender and project requirements. One bank’s published conditions also require at least 35% project completion and exclude financing for off-plan resale transactions. The bank decides eligibility, valuation, income assessment and documentation; a broker does not issue credit.

For ready property, published bank products indicate financing of up to 80% for qualifying expatriate buyers in certain cases. Different limits may apply above AED 5 million or for a second or investment property. Review [Dubai mortgages for non-residents](/dubai-mortgage-for-non-residents/) before committing to a payment schedule.

Reservation payments and EOI deposits need their own review. Whether a booking amount is refundable depends on the signed terms and the transaction stage. Do not rely on a message or sales presentation. Read [EOI and deposit refund rules in Dubai](/articles/eoi-deposit-refund-dubai/) before paying any reservation amount.

At off-plan handover, inspect the completed unit before accepting it. Dubai law provides a 10-year liability period for structural defects and one year for certain mechanical, electrical and plumbing installations from the completion certificate, but that does not replace a documented snagging inspection. Use a [Dubai snagging checklist for apartment handover](/articles/snagging-checklist-dubai/) and keep photographs, inspection notes and written requests.

## Which option fits your purpose?

### Living in Dubai now

Ready property is usually the more direct choice. You can inspect the actual home, complete the transfer, arrange utilities and move in or lease it after purchase. Off-plan may suit only if you have another place to live until handover and the specific future location matters more than immediate use.

### Rental income now

Ready property is the practical option because it can be leased after transfer. Off-plan generates no rent before handover. Do not compare an advertised off-plan payment plan with ready rental income without including the waiting period, service charges, financing costs, vacancy risk and transaction fees.

### A four- or five-year horizon

Off-plan may fit a buyer who does not need immediate occupation and can meet every SPA instalment without depending on resale. The buyer should still compare the contract price per sq ft against completed alternatives in the same area. In the latest data, off-plan was more expensive per sq ft at market level, so “future property must be cheaper” is not a safe shortcut.

### Budget without a mortgage

Off-plan can spread payments over the construction schedule, which may make cash planning easier. That is not the same as lower cost. Ready property requires more funds at transfer, but bank financing may be available at a higher loan-to-value ratio for eligible buyers.

Before choosing an off-plan project, verify its registration, escrow arrangements, SPA terms and delivery wording. Before choosing a ready unit, inspect the building, check ownership documents, existing tenancy status and approved service charges. A broker can help compare registered transactions and prepare the purchase process, but does not receive client money, exchange money, open accounts, provide loans, or give tax and legal conclusions. Tax questions should go to a tax adviser; contractual disputes and legal interpretation should go to a qualified lawyer. ## Frequently asked questions

### Is off-plan cheaper per square foot than ready property in Dubai?

Not across the latest market-wide DLD data. The median was AED 1,788 per sq ft for off-plan and AED 1,421 for ready property. Compare the same area and unit type before deciding.

### Can I resell an off-plan property before handover?

It may be possible through an Oqood assignment or resale process. The payment threshold and NOC requirement depend on the SPA and developer procedure; there is no confirmed universal DLD percentage.

### When do service charges start for an off-plan apartment?

Market guides differ on the exact start point. The law confirms that owners pay an area-based share and that charges require RERA approval, but the start date for a new buyer should be checked in the SPA and handover documents.

### Do banks provide mortgages for off-plan property?

Some do, with published financing up to 50% subject to bank and project conditions. One published bank condition requires at least 35% project completion and does not finance off-plan resales.

### What happens if an off-plan project is delayed?

Check the SPA first. Escrow protections, milestone rules and court remedies exist, but delivery timing depends on the contract and circumstances. Do not assume a standard grace period unless it is written in your SPA.

### Which is better for rental income: off-plan or ready property?

Ready property is generally the direct option because it can be rented after transfer. An off-plan unit cannot generate rent before handover.

### Can off-plan or ready property qualify me for a visa?

DLD and ICP materials describe a 10-year investor Golden Visa with an AED 2 million property threshold, while eligibility details require confirmation with the competent authority. Available owner-visa requirements refer to a fully built property, so do not assume an off-plan unit qualifies. Consult an immigration specialist for an individual assessment.
